THURSDAY, SEPTEMBER 19, 2013 7 P.M.

Minutes of the Meeting of the Rush Township Board of Supervisors

The meeting of the Rush Township Board of Supervisors was called to order by Chairman Shawn Gilbert at 7 o’clock p.m. Those in attendance were Vice-Chairman Robert Leibensperger, Supervisor Jeaninne Motroni, Secretary/Treasurer Darlene Fenstermacher, and William McMullen. Eight residents were also in attendance.

3. PUBLIC COMMENT

Joe Shamonsky – Thanked the Board for fixing the road near his house. Also, questioned the importance of the newly installed stop sign on Tamaqua Street.

Charlie Shamosky – Questioned why Rush Township only purchases fuel from Turkey Hill in Hometown. Cathy Schimpf stated that during the most recent emergency, Turkey Hill was the only available fuel station.

Joe Shamonsky Jr. – Questioned what was being done on Elizabeth Street. Also questioned the date for the sewer line replacement on Elizabeth Street.

Diane M. – Asked if rocks can be swept off of Jones Street.

4. POLICE REPORT. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.

5. MINUTES OF PREVIOUS MEETING – August 15, 2013. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes with changes.

6. TREASURERS REPORT – As of August 31, 2013. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.

7. APPROVAL OF CURRENT TOWNSHIP AND SEWER BILLS THRU

September 30, 2013. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.

8. MUNICIPAL REPORTS (SEWER, ROAD, ARRO, PRODESIGN PLUS). Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.

9. CORRESPONDENCE

10. ATTORNEY’S BUSINESS – On September 12, 2013 Rush Township commenced a civil action against Ankiewicz Enterprises, Inc. and Travelers Casuality Insurity Co. to protect its rights for possible damages dealing with Ankiewicz’s installation of defective sewer pipe on Bnosky St. The action was commenced by Writ of Summons in order to possibly forstall the running of the statute of limitations. Travelers is included as the issuer of the performance bond.

11. OLD BUSINESS – Opening of garbage & sewer bids. Bid awarded for Sanitary Sewer Improvements to Anrich Inc. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.

12. NEW BUSINESS

  1. A)Motion for the Rush Township Fire Police to aide in directing traffic at the intersection of 309 and 54 retroactive to September 15, 2013 for the United Dream Ride. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.
  1. B)Motion to adopt resolution 2013-12 authorizing the execution of an agreement with the Pennsylvania Department of Transportation for acceptance of SAFETEA-LU Funds. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.
  1. C)Motion to adopt ordinance #184 amending certain provisions of ordinance #112-94, titled transient retail business ordinance. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.
  1. D)Motion to be included on the list of residents who do not desire to have persons engaged in transient retail business on their property must submit a request in writing to the administrative office. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.
  1. E)Motion to change the October 17th meeting to October 28th at 7 PM. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.
  1. F)Motion to purchase 3 badges for Rush Township Fire Police. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.
  1. G)Motion to approve annual re-evaluation for Housing Rehabilitation Program. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Mrs. Fenstermacher polled the Board. All voted yes.

13. SUPERVISORS COMMENT

Ash pick up will be on Thursday’s, please call the office to be added to the list.
